Authorities Investigate Companies Over Online Pricing

Authorities have launched investigations into eight companies over concerns regarding their online pricing practices, with an additional 100 businesses expected to receive warnings.

The companies under scrutiny include StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical.

The Competition and Markets Authority (CMA) is conducting these investigations to assess how fees are displayed online, potential misrepresentation of time-limited offers, and the automatic enrollment of customers in optional charges.

Specifically, StubHub and Viagogo, secondary ticket selling platforms, are being examined for additional charges applied to ticket purchases. AA Driving School and BSM Driving School are under investigation for their fee presentation on websites, including the timing of fee disclosure during the purchase process.

Gold’s Gym is facing scrutiny for how it presents a one-time joining fee for annual memberships, especially regarding its introduction during the sign-up process. Wayfair is being investigated for time-limited sales, Marks Electrical for default opt-ins, and Appliances Direct for their use of time-limited sales and default opt-ins.

The CMA stated that these investigations are based on suspicions of consumer law violations, emphasizing that final decisions are pending. These cases mark the initial enforcement actions under the CMA’s new consumer protection authority.

Sarah Cardell, Chief Executive of CMA, highlighted the importance of ensuring transparent online shopping experiences for consumers, free from misleading pricing and coercive sales tactics. The CMA is committed to safeguarding consumer interests and promoting fair business practices.

In response, an AA Driving School spokesperson affirmed compliance with CMA regulations regarding fee transparency. A Viagogo spokesperson confirmed cooperation with the CMA investigation. The Mirror has reached out to Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct for comments.
