An individual illegally caring for a dog handed its deceased body to the owner in a plastic bag before physically assaulting him.
Owen Dempsey clashed with Martin Hulse when Hulse came to retrieve his French bulldog named Tank, which had passed away while under Dempsey’s care. Hulse and his partner cut short their vacation upon learning of their beloved three-year-old dog’s death.
The situation escalated as Dempsey turned aggressive upon their return to collect Tank’s body, accusing Hulse of implying he was responsible for the dog’s demise. Subsequently, Dempsey physically attacked Hulse by headbutting him and throwing punches, questioning if he was being accused of the dog’s death. Prior to this incident, Dempsey and his wife had been responsible for a German Shepherd that went missing and was never found.
Liverpool Magistrates’ Court revealed that Hulse had initially engaged Dempsey’s services as a dog sitter in June 2024 after seeing an online advertisement, initially without any issues or signs of mistreatment towards the dogs.
Prosecutor Angela Conlan outlined how Hulse and his wife had arranged for their five dogs to stay with Dempsey in Fazakerley, Liverpool, while they were on holiday from August 28 that year. However, on September 8, they received news from Dempsey and his partner Rachel via FaceTime that Tank had died.
Despite Tank having undergone a standard procedure six weeks earlier and appearing healthy before being left with Dempsey, the owners had no concerns about Tank’s well-being. They hurried back from their trip, requesting that Tank be preserved in a freezer until their return.
Under animal welfare laws, individuals providing dog boarding services as a business must possess the necessary licenses. Upon the owners’ return to the UK, Dempsey’s wife, Mrs. Dempsey, handed over Tank’s body to Mrs. Hulse in a plastic bag, claiming he had been stored in the freezer. However, the body was not cold and had started to decompose.
The situation escalated when Dempsey confronted Hulse, physically assaulting him by headbutting and punching him. Following the altercation, Dempsey was convicted of assault in absentia after a trial and admitted to breaching a community order related to his unlicensed dog boarding activities.
Dempsey, who had previous convictions for assault and other offenses, was sentenced to 16 weeks in jail. Despite protests from his wife, the judge emphasized the seriousness of the assault and the breach of the community order, leading to the immediate custodial sentence.
