Mother Sues After Autistic Son’s Tragic Classroom Death

A heartbroken mother has initiated legal action following the tragic death of her autistic son who fatally injured himself by hitting his head against the floor while confined in what was described as a “makeshift classroom prison.”

The 11-year-old boy, Joshua Sikes, passed away in his sleep in November 2024, succumbing to brain death resulting from head trauma sustained during the incident in the classroom. Reports indicate that Joshua, while restrained in a structure made of bookcases, bookshelves, and heavy-duty straps, expressed his distress by uttering, “I miss my mummy.”

In the lawsuit filed against special education provider Southeastern Cooperative Educational Programs (SECEP), Julie Xirau, the grieving mother, alleged that her son was left unattended as he kicked and struck his head on the floor while in restraint. The suit further claims that SECEP staff failed to intervene despite witnessing Joshua’s escalating distress.

On October 31, 2024, Julie received a call to pick up Joshua from school due to his misbehavior. Unaware of the extent of her son’s ordeal, she informed him that he would not be able to go trick-or-treating, unknowingly adding to his anguish. Joshua’s limited ability to communicate prevented him from disclosing the mistreatment he endured.

The following day, Joshua displayed lethargy and withdrawal, prompting Julie to seek medical attention. Despite medical advice to consult a specialist, Joshua tragically passed away in his sleep on November 3, 2024, from the injuries sustained in the classroom, unbeknownst to Julie until she discovered his lifeless body in bed.

Julie is seeking $150 million in damages from SECEP and four staff members, alleging negligence in providing medical care and failing to disclose the restraint and injuries to her. While local authorities investigated the incident and Joshua’s death, no evidence was found to implicate the staff. Child Protection Services attributed the alleged neglect to an unidentified perpetrator and dismissed claims of physical abuse.

Joshua’s obituary, published on the Altmeyer Funeral Homes & Crematory website, celebrates his unique spirit and the joy he brought to those around him. His playful nature and creativity shone through in his love for toys and outdoor adventures, leaving lasting memories for those who knew him.

The Mirror has reached out to SECEP for comment on the matter.
